RULES OF USE FOR THE WEBSITE

The Client or User and MAESTROS JOYEROS agree that the use of the Website or the digital application (online store) provided by MAESTROS JOYEROS will be subject to the following rules:

INFORMATION CONTAINED ON THE WEBSITE OR DIGITAL APPLICATION

The Client or User acknowledges and accepts that the information published or contained in said Website or digital application (online store) will be clearly identified in such a way that it is recognized that it comes from and has been generated by MAESTROS JOYEROS or by its suppliers, as well as the information provided by the Client or User in accordance with article 76 Bis, sections I and II of the Federal Consumer Protection Law.

MAESTROS JOYEROS cannot guarantee that a Customer or User will complete a transaction, nor can it verify the identity or personal data entered by the Customer or User. However, the information, concepts, and opinions published on this Website or digital application (online store) do not necessarily reflect the position of MAESTROS JOYEROS, nor of its employees, officers, directors, shareholders, licensees, and/or collaborators.

MAESTROS JOYEROS is not responsible for any information, opinions, or concepts expressed on the aforementioned Website or in the digital application (online store). In this case, the Client or User is recommended to consult with a specialist and/or professional in the field.

MAESTROS JOYEROS is not responsible for the information contained in the subpages of the Website or the digital application (online store), with the understanding that the use and monitoring of the same is solely at the risk and responsibility of the Client or User.

MAESTROS JOYEROS does not guarantee the veracity of third-party advertising that may possibly appear on the Website or in the digital application (online store), and will not be responsible for the correspondence or contracts that the Client or User enters into with said third parties 

MAESTROS JOYEROS reserves the right to block access or remove, in whole or in part, any information, communication or material that, in its sole discretion, may result in:

  • Abusive, defamatory, or obsceno;
  • Violating copyright, trademark, condidentiality, trade secrets or any intellectual property rights of a third party;
  • Ofensive; or
  • That in any way contracenes the provisions of this Contract.

In accordance with the provisions of article 76 Bis, section V of the Federal Consumer Protection Law, if the Client or User wishes to obtain more information on a specific topic provided by MAESTROS JOYEROS or by any of its suppliers, they must consult directly with each of them, as appropriate, and/or with a specialist in the subject matter.

The Client or User acknowledges that MAESTROS JOYEROS does not control or pre-censor the content available on the Website or in the digital application (online store), nor does it discriminate based on gender, including sexual preference and/or diversity. For this reason, MAESTROS JOYEROS assumes no responsibility for the content provided to said Website or digital application (online store) by independent suppliers or providers other than MAESTROS JOYEROS, and has no editorial control over the content, information and/or material generated and/or provided by third parties.

All opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties are those of their respective authors, and therefore MAESTROS JOYEROS assumes no responsibility for them. Likewise, MAESTROS JOYEROS does not guarantee the accuracy, veracity, completeness, and/or usefulness of any content provided by such third parties.

MAESTROS JOYEROS is not responsible for, nor does it guarantee the accuracy, completeness, veracity and/or reliability of any opinion, information, advice or statement expressed by MAESTROS JOYEROS through its Website or digital application (online store), and under no circumstances will MAESTROS JOYEROS be liable for any damage and/or harm, direct or indirect, caused by the trust that the Client or User places in information obtained through its Website or digital application (online store).

IMPORTANT

MAESTROS JOYEROS reserves the right to accept or reject the type of Products or Services to be promoted or marketed through the MAESTROS JOYEROS Website or digital application (online store).

Additionally, MAESTROS JOYEROS reserves the right to delete or modify the content of this Website or the digital application (online store), which in the sole judgment of MAESTROS JOYEROS, does not comply with its standards or which may be contrary to current legal regulations and, consequently, will not be responsible for any failure or delay that may arise when removing such material.

PRODUCT EXCHANGES AND RETURNS

For Exchanges and/or Returns of Products or Services, the warranty or cancellation policies apply. It is understood that the reason for the return will need to be reviewed, and the Customer or User must therefore accept the conditions stipulated in that section.

Depending on the nature of the request or complaint, the provisions set forth in Article 92 of the Federal Consumer Protection Law will apply.

If the Client or User wishes to exchange a Product, it must be done within the first 10 (ten) business days after receiving the Product.

The Client or User must notify MAESTROS JOYEROS via email at the following address: info@oroboleado.com so that they can inform them of the steps they must follow and/or indicate the procedure for exchanging the Product.

For Product Returns:

The Customer or User will have a period of 30 (thirty) calendar days to notify their sales advisor and/or MAESTROS JOYEROS of any manufacturing defect they observe in the Product. After this period, no claim will be filed under this assumption.

The Customer or User, or the Gift Recipient may return the Product in the following cases:

  • When the carat of the Product does not correspond to that agreed in the binding Contact between the Client or User and MAESTROS JOYEROS.
  • When the Client ord User considers that the product does not meet the technical and aesthetic specifications requested in the binding Contract between the Client or User and MAESTROS JOYEROS and said situaion is confirmed by MAESTROS JOYEROS.

After MAESTROS JOYEROS has accepted and confirmed the reason for the return, the Customer or User may opt for a refund of the full value of the Product or Service and/or the replacement of the Product with another (of the same characteristics) that meets the technical and aesthetic specifications requested in the binding Contract between the Customer or User and MAESTROS JOYEROS.

For Product Exchange:

The Client or User, and/or the Recipient of the Product may request the exchange of the Product purchased as a result of a binding Contract between the Client or User and MAESTROS JOYEROS, for another MAESTROS JOYEROS Product, observing the following specifications

  • The Client or User shall have sixty (60) calendar days to exercise the exchange of the Product, provided that such request is communicated to MAESTROS JOYEROS in writing and with acknowledgment of receipt, through any effective means of communication.
  • The exchange of the Product shall be subject to the evaluation of the criteria, controls, and quality standards (both technical and aesthetic) established by MAESTROS JOYEROS, in order to ensure that the piece is new and unused, in perfect condition, with tags and stickers (if applicable), as well as the original MAESTROS JOYEROS box and/or case, including its accessories and/or documents.
  • Once the evaluation of the criteria, controls, and quality standards has been approved, MAESTROS JOYEROS may, at its sole discretion, accept the piece at seventy percent (70%) of the total value of the piece originally purchased by the Client or User, taking into consideration the corresponding depreciation.
  • In the event that the Client or User resides in a State of the Mexican Republic other than where MAESTROS JOYEROS sales centers are located, the Client or User shall bear the cost of shipping to the Sales Center and/or Boutique of MAESTROS JOYEROS designated by their sales advisor for such purpose.
  • If the Client or User wishes to exchange their piece for another of lesser value, the Client or User shall receive a “Credit” to be used at any time, in a single transaction, toward the purchase of a Product from MAESTROS JOYEROS. Under no circumstances shall the value of the difference resulting from the exchanged Products be refunded in cash.

IMPORTANT

MAESTROS JOYEROS shall not accept any return and/or exchange if the Product shows signs of stretching, exposure to chemicals and/or hostile environments, abuse, misuse or improper use, evident intervention by third parties not authorized by MAESTROS JOYEROS, and/or evidence of cleaning by third parties not authorized by MAESTROS JOYEROS.

Under no circumstances shall MAESTROS JOYEROS be obligated to accept the return and/or exchange of a Product. However, it may take such initiative for the convenience of the Client or User and/or the Gift Recipient.

MONEY REFUNDS

In the event that the Client or User and/or the Gift Recipient returns a Product, the Client or User shall have the right to receive a money refund valid for the amount agreed upon in the binding Sales Contract between the Client or User and MAESTROS JOYEROS, in accordance with the provisions established in the preceding clause. A Gift Recipient shall not be entitled to receive a refund.

If MAESTROS JOYEROS determines that a Product complies with the terms and conditions for its return, MAESTROS JOYEROS shall notify the Client or User of such determination and shall make all reasonable efforts to credit the refund through the same payment method selected at the time of purchase, no later than thirty (30) business days following receipt of the returned Product.

In the event that MAESTROS JOYEROS must issue a refund for a Commercial Transaction derived from a Digital Purchase Order, the Client or User must choose a single refund method through which the reimbursement shall be processed. The Client or User may select among the following: Mercado Pago, bank wire transfer, or reversal of the charge to the credit card.

Furthermore, once the refund has been processed, the Clients or Users shall send to MAESTROS JOYEROS the proof of refund provided by the corresponding banking institution, or any documentation certifying that such refund has been effectively made. This documentation must be sent to the Customer Service Department of MAESTROS JOYEROS at the following email address: info@oroboleado.com

There are circumstances in which a Digital Purchase Order may not be processed due to causes beyond the control of MAESTROS JOYEROS, which cannot be foreseen, for example, events of force majeure or fortuitous events. In such cases, MAESTROS JOYEROS shall immediately inform the Client or User of the reason why the Order could not be processed and shall refund any amount charged to the Client or User, making it clear that in this process additional information may be requested to complete the refund procedure.

If, as a result of the foregoing scenarios or any other circumstances, MAESTROS JOYEROS must reimburse the Client or User an amount of money, such refund shall be made by means of an electronic voucher (Credit Note) for the total reimbursable amount.

CANCELLATIONS

In the event that the Client or User requires the cancellation of a requested purchase, and in order for the cancellation to be valid and not generate onerous charges, the provisions of Article 56 of the Federal Consumer Protection Law must be observed:

  1. Within the five (5) business days established by law, the Client or User must request the cancellation of the purchase so as not to incur a conventional penalty for cancellation. In such case, the Client or User shall only be required to cover a fee equivalent to five percent (5%) of the purchase value, corresponding to banking transaction handling and/or commission fees.

  2. After the five (5) business days established by law have elapsed, the Client or User must cover a conventional penalty of thirty percent (30%) of the value of the purchase. The Client or User shall also receive a credit note for the remaining seventy percent (70%) of the canceled purchase value.

IMPORTANT

The Client or User may exercise the right to revoke their Consent regarding the Commercial Transaction entered into, without liability, provided that the Product or Service acquired has not yet been shipped by MAESTROS JOYEROS for delivery to the User.

CANCELLATION BY THE CLIENT

  1. Digital Purchase Order. The Client or User shall have a grace period of twenty-four (24) hours following the placement of the order to cancel the Digital Purchase Order without liability. Once this period has expired, cancellation shall no longer be possible.
  2. Customized Orders:
    • Phase I (Design). The Client or User shall have the right to cancel the Services or the Digital Purchase Order up until the delivery of the initial design and/or, if applicable, any of its modifications, provided that such cancellation is communicated to MAESTROS JOYEROS in writing and with acknowledgment of receipt, through any effective means of communication. The cancellation of the Services or the Digital Purchase Order during Phase I (Design) shall be penalized with fifty percent (50%) of the preliminary deposit required to access the Personalized Design service. The remaining balance shall be refunded through the same payment method used to request the Service or the Digital Purchase Order.
    • Phase II (Manufacturing). Once the design has been approved, the Client or User shall have the right to cancel the Services or the Digital Purchase Order at any time and up until the delivery of the Product, provided that such cancellation is communicated to MAESTROS JOYEROS in writing and with acknowledgment of receipt, through any effective means of communication. The cancellation of the Services during Phase II (Manufacturing) shall be penalized with twenty percent (20%) of the total value of the Product, in accordance with the approved quotation.

3.Sales Center and/or Boutique.

    • At all times, the Client or User shall have the right to cancel the Services or the Digital Purchase Order, provided that such cancellation is communicated to MAESTROS JOYEROS in writing and with acknowledgment of receipt, through any effective means of communication. Otherwise, it shall be understood as the Client’s or User’s will and consent to continue with the requested Service or Digital Purchase Order.
